César Cuauhtémoc García Hernández has been a U.S. citizen every day of his life. Coming home from a trip abroad, he handed over his U.S. passport at the Atlanta airport and was held in a room whose door opened only from the outside. No one told him why.
Host, John Carlos Frey asks the Ohio State law professor a direct question: is the deportation machine operating lawfully? They work through a list of practices that may break the government’s own rules: arresting people who are following the asylum process, firing immigration judges and recruiting “deportation judges,” sending children into immigration court without lawyers, holding children beyond the limits of the Flores settlement, and deporting people to countries like South Sudan and Eswatini where they have no ties. The Supreme Court hears the third-country case in December.
A wide ranging discussion about law, ICE and the future of immigration enforcement.
