Who wins in a fight between Elon Musk and Sam Altman?

The trial between Elon Musk and Sam Altman has reached the courtroom. Well-known philanthropist Musk claims that OpenAI, which was set up as a charity, has been stolen, is no longer open source and is sufficiently non-profit. The tail is wagging the dog, Musk has said.
